Federal Judge Clashes With DOJ Over Trump’s Executive Order Targeting Law Firm

Washington, D.C. — A tense courtroom drama unfolded on Monday as a federal judge sharply rebuked a U.S. Department of Justice lawyer attempting to defend a controversial executive order signed by President Donald Trump. The order, issued on March 25, targets prestigious law firm Jenner & Block, raising serious constitutional concerns.

During the hearing, U.S. District Judge John Bates, a George W. Bush appointee, appeared visibly frustrated as DOJ attorney Richard Lawson struggled to justify the legality of the executive action. The order seeks to strip Jenner & Block employees of security clearances, cancel government contracts, and bar firm members from federal buildings and official engagements.

Lawson contended that the order was lawful because it instructed agencies to act “consistent with applicable law.” But Judge Bates retorted, “Give me a break,” when Lawson tried to justify Trump’s claim that Jenner & Block engages in racial discrimination — a claim unsupported by any court or federal finding.

The firm is fighting back through a lawsuit seeking a permanent injunction. Represented by elite law firm Cooley LLP, Jenner & Block argued that Trump’s order is an act of unconstitutional retaliation — a response to its previous employment of a lawyer who worked under Special Counsel Robert Mueller, among other grievances.

Bates questioned whether it made sense to suspend security clearances on a case-by-case basis under the executive order, calling it “a pretty strange reading.” He pressed Lawson on whether any rational basis supported barring Jenner & Block from government dealings solely based on Trump’s unilateral claims.

Michael Attanasio, representing Jenner & Block, urged the judge to strike down the entire executive order, likening it to political punishment. “It was set up to be one form of punishment, and it should be taken down the same way,” Attanasio said. “This time it gets taken down not on bended knee, but because this court enforces the constitution.”

Judge Bates, who had earlier issued a temporary pause on the order, promised a written ruling soon. His forthcoming decision could significantly shape the scope of presidential authority and the protection of legal institutions from executive overreach.
