In a fresh twist to an already controversial immigration episode, a U.S. federal appeals court has temporarily paused a lower court’s ruling that would have allowed hundreds of Venezuelan migrants deported to El Salvador to challenge their detentions through the legal process known as habeas corpus.
The migrants, deported in March 2025 under the 1798 Alien Enemies Act, were alleged by the Trump administration to be affiliated with the Tren de Aragua gang—claims disputed by civil rights groups. Instead of following standard immigration procedures, President Donald Trump authorized their immediate expulsion citing national security threats. Most of the deportees are now held in El Salvador’s mega-prisons, sparking concerns about human rights violations and due process.
On June 4, U.S. District Judge James Boasberg ruled that these individuals must be given the chance to contest their detentions and ordered the government to explain within a week how it would facilitate such challenges. However, the U.S. Court of Appeals for the D.C. Circuit has now issued a temporary administrative stay, giving itself more time to consider the government’s appeal.
Notably, the three-judge panel that granted the stay includes Judges Gregory Katsas, Neomi Rao, and Justin Walker, all appointed by Trump during his first term—further fueling debate over judicial impartiality and executive overreach.
The American Civil Liberties Union (ACLU), which is representing the deportees, has yet to issue a public comment.
Judge Boasberg, an Obama appointee, stopped short of ordering the U.S. government to return the deportees to American soil but insisted their right to challenge their removal must be preserved.
This case has attracted widespread attention as it tests the limits of a centuries-old law being applied in a modern immigration context, as well as the balance between national security claims and individual constitutional rights.
