Canadian artiste, Audrey Graham popularly known as Drake, has hit back against a subpoena ordering him to appear for a deposition in the murder trial of the late rapper, XXXTentacion.

Last week, Mauricio Padilla, a lawyer to Derek Williams, one of the suit’s defendants, named Drake as a person of interest.

According to Padilla, XXX and Graham had been feuding before his death. The lawyer referenced an Instagram post by the ‘Look at Me’ rapper in which he tagged Drake’s account back in February 2018.

“If anyone tries to kill me it was champagnepapi, I’m snitching right now,” the post read.

In a motion newly filed by Drake’s lawyers, it was argued that the original deposition subpoena was not properly served nor was it properly accepted by the artiste, Rolling Stone reports.

The motion read in part, “In a case such as this, it is both unreasonable and oppressive to subpoena an out of state party who has not been mentioned in any reports, any investigation, or referenced to have any involvement in this matter

“Based on the evidence so far provided in this case, there is video which purports to show the defendants allegedly as participants in the murder of the victim.”

It was further stated in the filing, that the request for deposition was “unreasonable” as there was no evidence to show that the ‘God’s Plan’ rapper “contributed to, had knowledge of, or participated in the alleged incident.”

XXXtentacion, whose real name was Jahseh Dwayne Ricardo Onfroy, was murdered by two masked men in June 2018 as he exited a Florida RIVA Motorsports dealership.

His killers also stole a bag belonging to the rapper which contained $50,000 in cash.
