Boston — A high-profile judicial misconduct case is underway in Massachusetts as Judge Shelley Joseph, previously charged with helping a migrant evade U.S. Immigration and Customs Enforcement (ICE), faces a disciplinary hearing that could determine her future on the bench.
Judge Joseph, whose original criminal case was dropped in 2022 following a controversial federal prosecution under President Donald Trump’s first administration, now faces formal proceedings before the Massachusetts Judicial Conduct Commission. The case centers on a 2018 incident in Newton District Court where Joseph allegedly allowed a Dominican man to leave through a backdoor of the courthouse, avoiding ICE agents waiting in the lobby.
Judith Fabricant, special counsel to the commission, framed the case as one deeply tied to the “integrity, impartiality, and independence of the Massachusetts judiciary.” A pivotal moment in the hearing revolves around a 52-second off-the-record sidebar during which defense attorney David Jellinek claims he asked the judge to send the defendant to the courthouse lockup, enabling an exit through a rear door.
Jellinek testified, “To the best of my recollection, she said then, ‘That’s what we’ll do.’”
However, Judge Joseph’s attorney, Elizabeth Mulvey, offered a sharp rebuttal, asserting that the lockup move was merely to permit private counsel between the man and his lawyer. She maintained that Joseph had no knowledge that the migrant would exit through the back and challenged Jellinek’s credibility, highlighting his granted immunity in the earlier federal probe.
“This case has painted her unfairly—either as a folk hero or a criminal. But we believe, at the end of this proceeding, the truth will give a more balanced picture,” Mulvey argued.
Though the criminal charges were dropped, the disciplinary outcome of this hearing will now decide whether Joseph retains her position as a state judge. The case echoes another brought this year against Wisconsin Judge Hannah Dugan, charged with similar actions involving immigration enforcement.
