The magistrate consequently sentenced the convict to three years and six months, but with an option of N100,000 fine.

Fadairo said that the convict should also restitute N12 million to the complainant, Mrs

Akinyemi Kemisola.

She said that the prosecution had proven beyond reasonable doubt that the convict was guilty of the charge preferred against him.

Earlier, the Prosecutor, Insp E.O. Adaraloye, told the court that the convict and others still at large committed the offences on Jan. 17, at about 2.30a.m., at Alafia Marica Street, Ota.

He said that the convict and his accomplices conspired to steal electrical wires valued at N12,000 belonging to the complainant.

Adaraloye added that they also damaged the conduit pipes in the process of removing the electrical wires.

The prosecutor said that the offences contravened Sections 390(9), 451 and 516 of the Criminal Code, Laws of Ogun, 2006. (NAN)
