Court restrains police from arresting Osun PDP leaders, members ahead assembly election

The Federal High Court on Thursday restrained the Nigerian Police from inviting, arresting and detaining leaders of the Peoples Democratic Party (PDP) in Osun State.

The restraining order was sought and obtained by the Osun chapter of the Peoples Democratic Party (PDP) ahead of the House of Assembly election on Saturday, March 18, 2023.

Justice Nathaniel Ayo-Emmanuel gave the order following an application brought before the court by leaders of the Osun PDP.

In an originating summons for the enforcement of their fundamental rights, Ibukun Fadipe, Sarafadeen Awotunde, Ojo Abiodun Michael and Abiodun Ojo Fafa told the court that PDP leaders and members have come under threat of indiscriminate arrest and unlawful detention by the Nigerian Police.

They stated that their arrest by the Police was at the instigation of the All Progressives Congress (APC) with respect to the forthcoming state House of Assembly election.

The PDP leaders prayed to the court to protect their fundamental rights to liberty, freedom of movement and association in relation to the electoral process.

Respondents in the suits brought before the court included the Inspector-General of Police (IGP), the Assistant Inspector General of Police (Zone XI Command Osun State) and the Osun State Commissioner of Police.

Ruling on the matter, Justice Emmanuel acceded to the reliefs sought specifically by and in respect of the named PDP leaders and members pending the determination of the substantive originating summons for right enforcement.

Newspot recalls that the leadership of Osun PDP had raised alarm about indiscriminate arrests of its leaders and members at the instigation of the APC.

Meanwhile, the Osun APC reacting to the accusation challenged PDP to name leaders of the party that have been arrested.

Prior to the presidential and National Assembly elections, the Osun APC also accused the PDP of attacking and maiming its members across the state.
