Papers filed to the high court on behalf of an insurance company being sued by the club insist Cardiff failed to get cover before his death at the age of 28.
Argentine player Sala was on a private flight from Nantes to take up a role with the then Premier League side in January 2019 when it crashed into the English Channel, also killing pilot David Ibbotson.
The club – owned by Malaysian billionaire Vincent Tan – is suing Miller Insurance LLP for £10m, claiming the Cardiff-based firm failed to say players would not be covered if they were not ‘timely informed’ of new signings such as their new star striker.
Lawyer Alistair Schaff KC, representing Miller, told the High Court that Cardiff contacted the company seeking £20m coverage for Sala, the morning after his flight went missing off the coast of Alderney.
The defence claims the club was ‘fully aware’ Sala was not insured and it was not their responsibility to ‘chase’ them after new signings had been made.
But Cardiff say brokers failed to properly explain the concept of an ‘insurable interest’ for player transfers, and the need for ‘prompt’ notification of a deal to secure coverage.
Their lawyers insist the insurance company’s defence ‘doesn’t seem to contain any surprises’. David Phillips KC will file a reply on their behalf to the High Court.
